Does a dad pay child support in NJ if the mother has a far greater income? And if so is it realistic to think that the dads financial obligations would be lessened due to the greater income of the mom? can anyone with any legal backgrounds or past experience as a father or mother be able to clarify this subject for me?   1. i dont think the mothers income changes the responsibilities of the dad, in ny it is a % thing the father pays 17% of his pay based on the past two income tax returns. it probably works the same in nj

  2. child support is all based on how much each parent makes if the mom has full custody and makes $$$ and you make $ you would only pay a small amount. if you have custody and make $ while the mom has $$$ she would n turn pay a greater amount.

  3. The person who does not have custody pays child support. If the father does not have primary custody, he will have to pay child support. The judge will need all financial statements from the father and I believe the child support is a percentage of his wage. If the financial situation of the father changes like a demotion, or loss of a job, then he can petition to change the amount owed.

  4. Her income doesn’t affect how much you will have to pay, only yours does. Child support is based off a percentage (varies by state) or an amount set in court based on the parent who does not have custodies income.

  5. Unless the father has sole custody of the child, no, his child support obligations are not waivered because the mother makes more money.
